These Terms and Conditions apply when you access our website or purchase products from us.

We supply products to both individual customers and professional customers, including nail technicians and other beauty professionals.

For the purposes of these Terms:

A Consumer is an individual purchasing products wholly or mainly for purposes outside their trade, business, craft or profession.

A Business Customer is a person or organisation purchasing products wholly or mainly for use in connection with a trade, business, craft or profession.

Certain statutory consumer rights referred to in these Terms apply only to Consumers.

Nothing in these Terms is intended to restrict any rights that cannot legally be excluded or limited.

3. Using Our Website

6. Placing an Order

When you place an order through our website, you are making an offer to purchase the products in your basket.

After placing your order, you will normally receive an email acknowledging receipt of it.

An acknowledgement email does not necessarily mean that your order has been accepted.

A contract between you and KM Nail Supplies is formed when we confirm that your order has been accepted or dispatched.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

We may change our prices at any time, but changes will not normally affect orders that we have already accepted.

If an obvious pricing error occurs, we may contact you before accepting the order and offer you the opportunity to purchase the product at the correct price or cancel the order.

Payment must be made using one of the payment methods offered at checkout.

By submitting payment details, you confirm that you are authorised to use the selected payment method.

Orders may be subject to payment verification and fraud-prevention checks.

We will not knowingly store complete payment-card details where these are processed securely by Shopify or another payment provider.

9. Delivery

We currently deliver within the United Kingdom unless otherwise stated.

Delivery options, charges and estimated delivery times will be displayed at checkout where available.

We aim to prepare and dispatch orders as quickly as reasonably possible.

Delivery estimates are not guarantees, and delays can occasionally occur because of courier disruption, severe weather, public holidays or circumstances outside our reasonable control.

Unless another delivery period has been expressly agreed, Consumer orders will be delivered within the period required by applicable law.

For Consumer orders, responsibility for the goods generally remains with us until the goods come into the physical possession of you or a person identified by you to receive them, subject to any exceptions provided by law.

Please ensure that the delivery address supplied when ordering is correct.

We cannot guarantee that an address can be changed after an order has been dispatched.

10. Consumer Cancellation Rights

If you are a Consumer purchasing online, you will normally have the legal right to cancel your order without giving a reason.

For most goods, you have 14 days from the day after you receive the goods to notify us that you wish to cancel.

After notifying us, you normally have a further 14 days to return the goods.

You may also use the model cancellation form at the end of these Terms, although you are not required to use that form.

Certain products may be excluded from the right to cancel where permitted by law.

For example, where goods are supplied sealed and are not suitable for return for health protection or hygiene reasons, the cancellation right may be lost once the seal has been broken.

11. Business Customer Returns

If you are purchasing wholly or mainly for your trade, business, craft or profession, the statutory Consumer cancellation rights described above do not apply to your purchase.

Any change-of-mind return by a Business Customer will be dealt with in accordance with our Returns & Refund Policy and any return arrangements specifically agreed between us.

This does not affect any rights a Business Customer may have in relation to faulty, damaged or incorrectly supplied goods.

12. Returns and Refunds

Our Returns & Refund Policy forms part of these Terms and explains how returns, cancellations and refunds are handled.

Where a Consumer validly cancels an eligible online purchase, any refund due will be made in accordance with applicable consumer law.

Where required, this includes reimbursement of the cost of our standard delivery service.

Any additional amount paid for an enhanced or premium delivery service is not normally refundable beyond the cost of our standard delivery option.

For change-of-mind returns, you may be responsible for the cost of returning the goods where permitted by law and where this has been explained to you.

13. Faulty, Damaged or Incorrect Goods

We are responsible for supplying products that comply with applicable legal requirements.

If you receive an item that is:

• Faulty.

• Damaged.

• Not as described.
